Federal Nondiscrimination Laws Include Pharmacies.
Everyone knows it is illegal to discriminate against anyone seeking healthcare on the basis of race, color, national origin, sex, age or disability.
But as a Pharmacy owner, are you fully compliant?
Pharmacy Nondiscrimination Regulatory Compliance
A final rule issued by the federal government regarding nondiscrimination of employees affects every healthcare business including Pharmacies. This regulation from HHS (Section 1557 of the Patient Protection and Affordable Care Act) outlines requirements to ensure equality and access with healthcare services. The final rule was effective July 18, 2016 and Pharmacies will need to take steps to comply with it.
Section 1557 makes it illegal to discriminate against anyone seeking healthcare on the basis of race, color, national origin, sex, age or disability. While nondiscrimination practices are already commonplace in Pharmacy, this regulation requires specific documents to be offered/posted. The services your Pharmacy will provide need to be posted as well stating the accessibility ensured to patients (including, but not limited to individuals with Limited English Proficiency and persons with disabilities).
The PRS NON-DISCRIM.Track program provides written processes, associated documentation and related employee training for these requirements.
